Q2c: Why were leaseholders not given the right to buy the freehold when it was transferred in 2013?

A: Central Street Properties (Pear Tree) Limited owned the site and transferred it to Central Street Developments LLP to enable Mount Anvil to develop the site.  Part of this original transaction was the right for Central Street Properties (Pear Tree) Limited to purchase back the freehold when the building work was completed.  This transfer back took place in July 2013.  The statutory ‘Right of First Refusal’ for qualifying leaseholders to acquire the freehold did not apply, as the transfer was a provision in the original development agreement, which pre-dates any of the Dance Square tenants leases.
